1. Hosting Terms of Use

1.1 Email Sending Limit: The hourly email sending limit is a maximum of 10 emails. This limit is set to prevent abuse and to protect server resources. ekasunucu.com reserves the right to change this limit based on system requirements.

1.2 Backup Retention Period: Backups taken by the customer are stored on the server for a maximum of 15 days. After this period, they may be automatically deleted by the system.

1.3 Misuse of Hosting Packages: Packages must only be used for hosting websites. Use for file sharing, data storage, download centers, or remote backups is strictly prohibited.

1.4 Spam / Bulk Emailing: Packages cannot be used for spam or bulk email sending. ekasunucu.com may suspend or restrict such services upon detection of such activities.

1.5 Data Backup Responsibility: The customer is responsible for backing up their own data. Although periodic backups are performed by the system, our company does not accept responsibility for any data loss.

1.6 Backup Quota: The goodwill backup quota is set at 5 GB. No backup guarantee is provided for data exceeding this limit.

1.7 Site Migration Service: No 100% success guarantee is provided for free site migrations. Some elements may not be transferred due to technical constraints.

1.8 Unlimited Features and Resource Usage: Resources marked as unlimited (traffic, disk, etc.) are subject to fair usage policy. The monthly traffic checkpoint is 50 GB, and the disk usage checkpoint is 10 GB. Packages may be limited based on CPU usage.

1.9 CPU Usage Limit: By default, a maximum of 100% CPU usage is allowed per package. In advanced packages, this may be increased up to 400%.

1.10 File (Inode) Limit: A default limit of 200,000 files (inodes) is applied.

1.11 Alias / Parked Domain Usage: Parked domains may only be used to mirror the existing website. They cannot be used for email or other services. Otherwise, the service may be suspended.

1.12 Addon / Parked Domain Usage Conditions: Only domains owned by the customer and registered in the ekasunucu.com panel are allowed. Proof of ownership is required for domains registered with other companies.

1.13 PHP Functions: Only the PHP functions allowed in the control panel can be used in shared hosting packages. Function support should be checked when installing third-party modules.

1.14 SSH Access: SSH access is not available in shared hosting environments.

1.15 Forbidden PHP Functions: PHP functions that make system calls such as exec, escapeshellarg, popen, proc_open are prohibited.

1.16 Resource Usage Monitoring: ekasunucu.com regularly monitors system resource usage. If limits are exceeded, the customer may be asked to reduce usage. Otherwise, the service may be limited, suspended, or redirected.

1.17 Infrastructure Changes: ekasunucu.com may make IP, server, or infrastructure changes without prior notice based on technical requirements.

1.18 Promotional Campaigns Usage: Promotions and campaigns are specific to individuals. Abuse using different accounts may result in service suspension and fees may be charged.

1.19 Single Account Rule: Only one main account is assigned per customer. If multiple accounts by the same person are detected, services may be terminated.

1.20 Termination of Service: ekasunucu.com reserves the right to terminate any service without providing a reason and may issue a refund.

1.21 Right to Modify: ekasunucu.com reserves the right to modify service terms and technical details at any time.

1.22 Legal Responsibility and Notification: EKA SUNUCU is an officially approved hosting provider by BTK under Law No. 5651. As such, it is not responsible for monitoring or controlling hosted content. However, if you have any requests or complaints regarding illegal or non-compliant content, please contact us. 2. Domain Names Not Allowed for Registration/Transfer

Domain names with the following characteristics cannot be hosted or transferred on our servers:

• Domains containing content contrary to Law No. 5651

• Domains containing commercial bank names (e.g., garantisube, akbanksube)

• Domains focused on credit card/bill payment (e.g., kartode, faturaode)

• Domains referencing game names (e.g., metin2, mt2)

3. Prohibited Content for Hosting

The following types of content are strictly prohibited on our servers:

• Content that violates Law No. 5651

• IRC servers / bots / scripts

• Proxy / anonymizer scripts

• Phishing content

• Spam email tools

• File upload / mirror services (like Rapidshare)

• Gambling, HYIP, Ponzi, pyramid scheme content

• Bitcoin mining / exchange platforms

• Pornographic, child abuse, illegal content

4. Policies

4.1 Resource Usage: To ensure efficient system usage for all customers, abuse of resources like disk space, traffic, or CPU is not allowed.

4.2 Email Service: A zero-tolerance policy against spam is enforced to maintain healthy email traffic.

4.3 Data Security: Your data is your responsibility. Regular backups are recommended. System backups are only for assisting in technical failures.

4.4 Fair Usage: All packages and services are subject to fair usage principles.

4.5 Staff Safety: Users who behave rudely or harmfully towards ekasunucu.com staff will have their services immediately terminated without a refund.

4.6 Complaints and Feedback: Customers can always contact us about any issues or abuse cases. All requests are carefully reviewed and responded to as quickly as possible.

1. Parties

3.1. The Company shall process the Customer’s personal data solely for the purposes stated within this agreement and in compliance with applicable data protection laws.

3.2. The Customer consents to the processing, storage, and, where necessary, transfer of their personal data to third parties by the Company.

3.3. The Company shall take appropriate security measures to prevent unauthorized access to personal data. However, the Customer acknowledges that data transmission over the internet cannot be guaranteed as completely secure.

4. Storage of Personal Data

4.1. Personal data may be retained for a limited period even after the termination of this agreement. This duration will be determined in accordance with applicable laws and regulations.

5. Access to Personal Data

5.1. The Customer has the right to access their personal data and request that it be accurate and up to date.

5.2. The Customer has the right to restrict or request the deletion of their personal data, subject to applicable legal requirements.

6. Privacy Policy and Amendments

6.1. The Company shall provide the Customer with its privacy policy regarding the processing of personal data and commits to complying with it.

6.2. The Company reserves the right to amend this agreement and the privacy policy as necessary. Any such changes will be communicated to the Customer and, if required, consent will be obtained.

7. Termination of This Agreement

7.1. This agreement may be terminated by mutual consent of the parties.

7.2. Upon termination, personal data may continue to be stored in accordance with the provisions of this agreement.

8. Jurisdiction and Governing Law

8.1. This agreement shall be interpreted in accordance with Turkish law. The parties agree that the courts and enforcement offices of Istanbul shall have jurisdiction.

9. Final Provisions

9.1. This agreement shall enter into force upon acceptance and approval by the parties.
